Referring a dismissal dispute to the CCMA

The Commission for Conciliation, Mediation and Arbitration, known as the CCMA, gives employees and employers a fairly informal way to resolve workplace disputes. If you believe you were dismissed unfairly, the first step is usually conciliation, where a commissioner helps both sides try to reach a settlement. Strict time limits apply to referrals, so it is important not to wait.

Gather your contract, payslips, any warning letters and the dismissal notice before you refer the matter. Write down dates and what was said while it is fresh. Employers should prepare in the same way. We can advise either side on the strength of the case and represent you at arbitration where the rules allow legal representation.
